The material on this Website is intended for general information and may be revised without notice. We exercise the utmost care in the creation and development of our Website and use sources that are considered to be reliable. However, we cannot guarantee the exactness, completeness or topical interest of the presented information, or the zero-error and/or uninterrupted functioning of the Website. You therefore cannot derive any rights from the presented information.

We attach great importance to careful treatment of personal details. Personal details are therefore processed and protected with all due care and attention. In this we observe the requirements of the General Data Protection Regulation. We are responsible for the data-processing. In the present privacy statement We explain what personal data We collect and use and for what purposes. The following data protection declaration explains to you what data is collected on our websites and which data we process as well.

5 Personal Data

Personal data are data on factual or personal circumstances of a particular or identifiable natural person. This includes, for example, your name, telephone number, address, as well as all data, which you share with us when you register and create your personal account at E-Flux. Because your charging station is connected to E-Flux Back Office, or in case you have a charge card subscription.

Statistical data that we collect, for example, during the visit of our Website and which can not be directly linked to your person, are not included. For example, statistics about which pages of our store are particularly popular or how many users visit certain pages of our Website.

We also collect charging data when You charge your electric vehicle or your charging station is used by You or a third party. This is also dependent on the type of subscription You have with Us.

Collecting and processing data
We receive, store and use exclusively the personal data sent by You when visiting and using our Website and related services, or when it is clear on sending that the data is in fact meant for us. For example, if you fill in a form on the Website, such as a contact and registration form, or send us an e-mail, then the data that you send us is kept as long as necessary, according to the nature of the form or the content of your e-mail, for us to process it and send a reply.

We collect the following data:

  • Gender;
  • First name and surname;
  • Address;
  • Date of Birth;
  • Electric Vehicle brand;
  • Telephone number
  • E-mail address;
  • Bank account number;
  • Other personal data actively provided by you. For example data provided by telephone or correspondence;
  • Data about your activities on our Website;
  • Data about your visits of different sites (because E-Flux might be part of an advertisement network);
  • IP address;
  • Usernames and passwords of personal accounts at E-Flux;
  • Data of charge sessions which are collected from E-Flux charge station or charge card.

Employees that work for the HR, Marketing, Finance, and Sales department have access to personal data.

5.1  Why do we collect data?
We collect data for the following purposes:

  • Performance of the agreements between You and Us;
  • If You do not have an agreement with Us but use a E-Flux Charge Point for a charging session of your Electric Vehicle we collect your charging data to execute the agreement between Us and your charge card provider;
  • Processing your payment or payment obligation;
  • Registration and allocation of energy consumption of charging stations;
  • Sending our newsletter;
  • Contacting You if this required to perform our services;
  • To inform You about changes in our services and products.
  • To deliver the ordered products and services to You;
  • Use of the Website and for links to third party websites via our Website;
  • We analyze visitor behavior on our Website to improve our Website and offer You personal advertisement for our products and services;
  • We also use your data for market and opinion research. Of course we use this anonymously for statistical purposes and only for Us. Your responses to surveys will not be passed on to third parties or published. We use and processes your personal data for market and opinion research purposes;
  • We process your data if we are required by any law or regulation to do so. For example information we require for our tax filing.

5.2 Registration system
Are you visiting our Website? Then we will collect and use data. We need to do this for the benefit of our business operations, so we can offer You our services. Also to inform you about news, products and services.

If You send Us an e-mail or any other communication to Us, we may retain those communications in order to process your inquiries, respond to requests and improve our Website and services.

If You sign-up via one of our registration forms we need to collect some personal information (such as, but not limited to: your name, e-mail, address and login details) in order to identify You or to give You some assistance of the use of Our products and services.

Information that You provide may be used to contact You, for example, for new products on the Website, or to offer You deals, discounts, newsletters and other content, products or services that may be of interest to You, unless You inform Us through support@E-Flux.com that You do not wish to receive any offers from Us.

We will not use this Website to collect special personal data such as information regarding political views, race, religious beliefs, health, criminal-law data, or other matters.

5.3 Newsletter
If You do not wish to receive the newsletter any more from Us, You can unsubscribe yourself via the unsubscribe link at the footer of every newsletter.

5.4 Accounts My E-Flux
We set up a password-protected direct access to the Back Office if You register for one of our subscriptions which provides for this access. Here you can view data dependent on your subscription. You agree to keep the personal access data confidential and not to make it accessible to unauthorized third parties. We can not accept liability for misuse of passwords. 

5.5 Third parties
Your personal data will only be passed on to third parties or otherwise transmitted if this is necessary for contract processing, providing, use and improving the Website, if You have previously given your consent, or is required by law. Within the framework of processing, for example, the hosting provider used by Us receives the necessary data for order and order processing. The data thus provided may only be used by our service providers to fulfill their task. Any other use of the information is not permitted and is not carried out by any of our service providers.

If We use a third party for data processing We will conclude a data processing agreement with this third party.

5.6 Storage of Data
We will not store your personal data any longer than:

  • Personal data we receive after registration we will store as long as your personal account at E-Flux is active. You will have a personal account when you concluded an agreement for a charge card or Back ofice subscription with Us. After termination of the charge card account we wait 4 months from termination date, before we delete your details. Charge Point Operators have the right to send delayed charge sessions 3 months prior to the actual date you’ve charged.
  • Data we collect through our social media accounts will be stored for a maximum period of 24 months.
  • Data we collect through our Websites will be stored for a maximum period of 48 months.

5.7 Request your data

In the context of data portability you can always view and request your data:

  • If you have a subscription for a charge station or charge card you are able to view and change your personal data in your E-Flux account.
  • If you fill out a form on our Website we store this information on our secured server. If you want to request information please send an e-mail to support@e-flux.nl

 

6 Cookies

6.1 What is a cookie?
A cookie is a simple little file stored on the computer hard drive. Most browsers are normally configured to accept cookies, but You can also set up your browser to refuse all cookies or to send You a message when a cookie is sent. During your visit to our Website it is possible that Google and other parties make use of their own cookies.

When the cookie is activated, an identification number is assigned to the cookie and an assignment of your personal data to this identification number is not made. Your name, IP address or similar data that would allow the cookie to be assigned to you will not be inserted into the cookie. On the basis of the cookie technology, we receive only pseudonymized information. Your data will never be combined with possible personal data stored with Us.

When You visit the Website We use cookies to collect certain essential data (such as but not limited to: language settings, login details and IP-address) in order to help Us remember Your login details, authentication data, language settings and other essential information which helps You to navigate through Our Website.

The Website and its applications such as the E-Flux app use cookies to collect certain demographic information such as your geolocation to give You some assistance of the use of Our products and services.

On the subsites of the Website, for example, but not limited to ‘My E-Flux’ We use cookies to help Us remember your login details and authentication data, which helps You to navigate through our subsite. We also serve cookies for the period of time You use the subsite after login in in order to help us monitor the traffic of the subsite and your preferences and user experience on our subsite.

Google Analytics and Google Remarketing Analytics in 6.4.2 is a service of Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses cookies, which allows an analysis of the use of our Website by Google. The information collected anonymously about the use of our Website (including your IP address) collected by the cookie is generally transferred to a server of Google in the USA and stored there. Your IP address will therefore be collected by Google only in abridged form, which ensures anonymization and does not permit conclusions about your identity. 6.3.2 Google Analytics Remarketing
To display online advertisements to You when visiting our Website we have a remarketing list. A remarketing list is a collection of tracking cookies from people who visited our Website.

Making the remarketing is one of the key steps for setting up a remarketing campaign, so We can show personal advertisement on our Website to You. If You do not want to allow this Cookie you can opt-out as stated in 6.3.

6.3.3 Social plugins
Our internet presence uses social plugins (“plugins”) from different social networks. With the help of these plugins, you can, for example, share content or recommend products. The plugins are deactivated by default on the Website and therefore do not send any data.

By clicking on the “Enable Social Media” button you can activate the plugins. The plugins can of course be deactivated with one click again.

When these plugins are enabled, your browser connects directly to the servers of the respective social network as soon as they access a website of our internet presence. The content of the plugin is transmitted directly from the social network to your browser and integrated into it by the website.

By integrating the plugins, the social network gets the information that you have called up the corresponding page of our internet presence. If You interact with the plugins, like the Facebook “Like” button or make a comment, the corresponding information from your browser is sent directly to the social network and stored there.

Even if you are not logged into social networks, web pages with active social plugins can send data to the networks. An active plugin is used to set a cookie with an identifier every time the web page is accessed. Because your browser does not send this cookie any time You connect to a network server, the network could basically create a profile that called up the websites of the users belonging to the ID. 7 Protection of privacy and passwords

We apply strict data protection procedures, for instance to prevent unauthorized access to personal data. We make use of safe connections through which all personal information between You and our Website is protected during recording. Passwords are stored in encrypted form, so neither We ourselves nor any outsiders can possibly discover them. Data that is no longer needed is removed. You can even request change or deletion of data (see below). All our Websites make use of a SSL certificate.

From time to time, We will revise these Statements, without further notice. We recommend that You regularly check whether these Terms has been revised. However, We will notify You via a prominent notifications on our Website about any major changes that would negatively impact your interests, although We are not envisioning any such changes in the near future.
